Steven de Lira came to the Netherlands in 1994 from CuraƧao to study industrial engineering and management. After graduating, he set up Opensa, a firm specialising in organisational consultancy and SilkBricks, a software company that makes tools designed to accelerate innovation processes within businesses.

Last Friday we entered the last remaining confirmative application into our systems (5290). This is the first step in the processing of the still existing backlog. If you have filed a confirmative application before October 10 and so far have not received a confirmation, then please contact us by e-mail.

As of October 10, 2011, one year after entry into force of the Wet Merken Bes, it is no longer possible to file Confirmative applications of Antillean trademarks for Caribbean Netherlands.  Registering trademarks form now on is only possible through filing a new application. In the last update of TM talk, the option to submit a confirmative application has been removed and the form for filing a confirmative application is no longer available on the website.

Friday, October 7 some changes to the Wet Merken BES and its Implementation will be published. These changes will take effect on October 8, 2011.

The online trademarks register has been available since 1 September. The register contains trademark registrations and pending applications valid in the Caribbean Netherlands (Bonaire, St. Eustatius and Saba). The register does not include international registrations that are valid in the Caribbean Netherlands.

Since the BOIP started accepting trademark filings for the Caribbean Netherlands (Bonaire, Sint Eustatius and Saba) we have received 1891 applications, of which 1759 to confirm filings and 132 new filings.

We would like to remind you that the rights to pre-existing trademark filings for the Netherlands Antilles can be confirmed for the Caribbean Netherlands up to and including 9 October 2011.

A form has been made available on the website specifically for renewing your Caribbean Netherlands trademark registration.

As of this week BOIP has the possibility to publish the Caribbean Netherlands trademarks. A page has been added to our website (http://www.boip.int/en/carib). The registered trademarks are visible on this website. All the data concerning a specific trademark can be made visible by clicking the trademark's number. The publication only contain registered trademarks. As you will notice there are only three trademark in the publication at this moment. This number will increase in the days to follow.

The country codes for the subdivided Antilles used by WIPO and applicants of international trademarks have recently been made definite. The Caribbean Netherlands (Bonaire, Sint Eustatius and Saba) was assigned the country code BQ. Curacao was allotted the code CW and Sint Maarten now has the code SX.

The Trademarks Act for Bonaire, Sint Eustatius and Saba (Wet Merken BES) and the implementation regulations do not provide for a trademarks register survey for the Caribbean Netherlands. The BOIP does not offer such a survey itself and has no intention at present of doing so. Although the majority of current applications are confirmative applications, the Office realises that the question of how applicants can tell if a trademark is still available is bound to arise soon.
